Property Documents to Review Before Buying in India
A practical checklist of property papers and questions to organize before you commit to a purchase.

Buying property involves more than agreeing on a price. The documents, the seller’s authority, the property description and the payment terms all deserve careful attention. This checklist helps you prepare for a meaningful conversation with a local property professional; it is not a substitute for a title search or advice on a specific transaction.
Start with the property and the seller
Gather the documents that describe the property and identify its current owner. Compare names, property numbers, boundaries and addresses across the papers you receive. If the seller is acting through another person, ask for the document that explains that person’s authority.
A mismatch does not always mean the purchase must stop, but it is a reason to ask for an explanation and supporting records before paying or signing.
- Identity and authority documents for the seller
- Documents describing the property and ownership history
- Any power of attorney or other authorization being relied upon
Understand what is being transferred
Ask what exactly is included in the sale: the land, built area, parking, fixtures, shared facilities or other rights. Check whether the written description matches what you inspected. Keep copies of plans, approvals and correspondence that may affect your expectations.
Your adviser can help identify which records need to be checked with a local authority, registry, lender or other source for the property involved.

Read the payment and possession terms
The agreement should make the price, deposits, payment milestones, possession date and responsibility for expenses understandable. Ask what happens if a required document is not produced or a milestone is missed. Do not rely only on verbal assurances about refunds or handover.
If a loan is involved, discuss the lender’s documentation requirements and how the payment schedule interacts with your financing.
- Total consideration and every payment milestone
- Conditions before completion and possession
- Responsibility for taxes, dues and transaction costs
- What each party must do if the transaction cannot complete
Before you sign
Create one folder containing the latest draft, earlier versions, receipts and questions. Mark any clause you do not understand. Ask an independent professional familiar with the relevant location to review the papers and explain the next steps before you commit funds. The checks required vary by property type, location and transaction structure.
